End-User License Agreement (EULA) for SmileyDude
Introduction
This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and the creators of SmileyDude, an AI image generating app ("App"). By installing, copying, or otherwise using the App, you agree to be bound by the terms of this EULA.
1. Grant of License
Usage: SmileyDude grants you a non-exclusive, non-transferable license to use the App for your personal, non-commercial purposes according to the terms of this EULA.
2. Restrictions
No Modification: You may not modify, adapt, or translate the App.
No Reverse Engineering: You may not reverse engineer, decompile, or disassemble the App, except to the extent that such activity is expressly permitted by applicable law.
No Transfer: You may not rent, lease, lend, sell, redistribute, or sublicense the App.
3. Intellectual Property
Ownership: All rights, title, and interest in and to the App, and any copies thereof, remain with SmileyDude (or its suppliers or licensors). All rights not expressly granted are reserved.
4. User Content
Rights: You retain all rights to any images, text, or other content you generate or upload using the App.
License to SmileyDude: By using the App, you grant SmileyDude a non-exclusive, royalty-free license to use your content as part of the App functionality.
5. Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice from SmileyDude if you fail to comply with any term(s) of this EULA. Upon termination of the EULA, you shall cease all use of the App.
6. Disclaimer of Warranties
You expressly acknowledge and agree that use of the App is at your sole risk. The App and any services performed or provided by the App are provided "as is" and “as available”, with all faults and without warranty of any kind.
7. Limitation of Liability
To the extent not prohibited by law, in no event shall SmileyDude be liable for personal injury, or any incidental, special, indirect, or consequential damages whatsoever.
8. Changes to the EULA
SmileyDude reserves the right to modify this EULA at any time. By continuing to use the App after such modifications, you agree to be bound by such modifications to the EULA.
9. Governing Law
This EULA will be governed by and construed in accordance with the laws of the jurisdiction where SmileyDude is based, excluding its conflicts of law rules.
